Since the GDPR Personal Data Protection Act, administering alcohol and drug tests has not become easier, not even in healthcare institutions. There are some exceptions such as the ACT on means testing for violent offenders; Based on this new law, the police have the authority to test arrested suspects of violent crimes for which pre-trial detention is permitted for the use of alcohol and drugs. If there is an indication based on external symptoms that alcohol or drugs have been used, an order may be given to perform a breath test and/or a saliva test for drugs. If this test is positive, a follow-up investigation will be initiated. This follow-up examination consists of a breath analysis or a blood test. During a blood test, a forensic doctor is called in, who takes blood from the suspect.

Doctor-patient confidentiality

If there is a medical need to test for alcohol and/or drugs, knowledge about this first and foremost falls under medical confidentiality. This also applies if, during diagnostic examination or medical treatment, substances are found in or on the body of a patient that appear on lists mentioned in the Opium Act. At the same time, the institution cannot tolerate violation of the prohibitions and it is an unacceptable threat to the safety of its own employees, other patients and visitors.

If blood needs to be taken from a person staying in the healthcare institution in connection with driving under the influence, the police will call in the forensic doctor who is authorized to do so. GGD doctors have been designated per region for the forensic task of taking blood. The forensic doctor contacts the contact officer of the healthcare institution (unless otherwise agreed) to carry out his/her task. The forensic doctor assesses, possibly in consultation with the treating physician, whether it is medically justified to take blood.
